As “Holder” of the Data Treatment as per art. 4, n. 7, Fontana Pietro S.p.A. informs you about the processing of the data provided by yourself as a recruiting applicant, potential future employee or collaborator.
1. Purposes of data processing (art. 13, paragraph 1, letter c)
We inform you, as per art. 5, paragraph 1, letter b, that your data shall be stored and used for a possible later recruitment.
Data processing for the above mentioned purpose is legitimate as per art. 6, paragraph 1, letter b and f, and refers to:
b) the execution of a contract sealed with the applicant concerned or the execution of pre-contractual measures required by the applicant itself
f) the legitimate need of the Holder of the data used to evaluate if the characteristics and skills of the chosen applicant are in line with the professional required by Fontana Pietro S.p.A.
Note that the consent of the applicant concerned is not necessary for the above mentioned purposes, as art. 111-bis of D.Lgs.196/03 (Code on Personal Data Protection) quotes: “The consent for Processing of personal data written in the curricula is not required”.
2. Ways of data processing
Personal data necessary for the above mentioned purposes shall be handled in an automated, electronic or magnetic way.
3. Subjects of personal data (art. 13, paragraph 1, letter e)
Personal data shall be shared and acknowledged only by the following authorized people:
- employees of Fontana Pietro S.p.A. in charge of the recruitment
- professionals or companies in charge of the recruitment on behalf of Fontana Pietro S.p.A.
4. Data transfer abroad (art. 13, paragraph 1, letter f)
Personal data shall be stored at the Holders’ Headquarter. The above mentioned people aware of the data are based in Italy or within the EU.
5. Data storage (art. 13, paragraph 2, letter a)
If the applicant is hired, personal data shall be kept by Fontana Pietro S.p.A. for the duration of the employment and then for the period required by the law.
Otherwise, if the applicant does not fit the position open and is not selected, the data shall be kepts by Fontana Pietro S.p.A. for one year only.
6. Rights of the concerned applicant (art. 13, paragraph 2, letters b), c) e d)
The applicant has the right to ask the data Holder for: personal data access (art. 15), modification (art. 16) cancellation (art. 17); processing restriction (art. 18) or total obstruction (art. 21) and data portability (art. 20); besides, the applicant deserves the right to make possible complaints to the Data Protection Authority (art.77).
The above mentioned rights can be exercised at any time by simply sending a registered letter or an e-mail to the Data Processing Holder (addresses below).
7. Data communication (art. 13, paragraph 2, letter e)
The communication of the data is compulsory: in case the applicant refuses to communicate its personal data for the above mentioned purposes, recruitment procedures stop preventing the applicant to get the chance of being hired by the company.
8. Profiling (art. 13, paragraph 2, letter f)
No automated decision-making processes are applied to applicants’ personal data, not even profiling, as per Art. 22.
9. Principles applied to the data treatment
As per art. 5, applicants’ personal data are:
- processed in a lawful, correct and transparent way in respect of the concerned person ("lawfulness, correctness and transparency");
- collected for specific, explicit and legitimate purposes, and subsequently processed in a way that is not incompatible with such purposes ("purpose limitation");
- adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed ("data minimization");
- accurate and, if necessary, kept up to date ("accuracy");
- stored in a form that allows the identification of the concerned people for a period of time not exceeding the achievement of the purposes for which they are processed ("storage limitation");
- processed so as to ensure the proper level of personal data security, including protection from unauthorized or illegal processing and from accidental loss, destruction or damage, by means of appropriate technical and organizational measures ("integrity and confidentiality").
